Waiheke Jazz Festival 2026 - Official Promoter Terms and Conditions
Governing Terms: These Terms and Conditions (T&Cs) are set by the Festival Promoter and govern the sale of tickets to all individual events comprising the Waiheke Jazz Festival 2026.
Agency: iTICKET.CO.NZ Limited acts solely as the ticketing agent for the Promoter. All claims, complaints, and liabilities for the event's conduct and delivery rest exclusively with the Promoter.
Precedence: These Promoter T&Cs apply specifically to the Festival. Where a conflict exists between these T&Cs and the general iTICKET T&Cs, these Promoter T&Cs will prevail.
Statutory Rights: This policy operates subject to the mandatory rights afforded to consumers under the New Zealand Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA).
All tickets are purchased on a final-sale basis.
Booking fees, transaction fees, and delivery fees are services already rendered by the ticketing agent.
Per-Event Basis: Each ticket grants entry to a single, specific event. The cancellation of one event does not grant a right to a refund for tickets purchased for any other event within the Festival.
If a specific event is cancelled or materially changed for reasons within the Promoter's reasonable control (e.g., failure to secure the advertised headline act, major breach of service), the ticket purchaser may be entitled to a refund of the ticket face value, as required by the CGA.

This section applies to events cancelled or delayed due to circumstances outside the Promoter's control.
Force Majeure Event Defined: A "Force Majeure Event" means an event, circumstance, or cause which is beyond the reasonable control of the Promoter, including, but not limited to: natural disasters, earthquakes, or severe adverse weather that makes the event unsafe to hold (as determined by the Promoter or Venue management), fire, flood, pandemic or epidemic (including government-mandated lockdowns), acts of terrorism, or civil unrest.
Exclusion of Liability (CGA Exemption): The Promoter shall be excused from all liability under the Consumer Guarantees Act 1993 if the event is cancelled or significantly delayed due to a Force Majeure Event, as the failure is due to a cause outside the control of the Promoter and its agents.
No Rain Date - Non-Refundable: The Festival operates on a No Rain Date policy. Where an event is cancelled due to a Force Majeure Event, the purchaser acknowledges that they have no right to a refund of the ticket price or any associated fees, based on the CGA exemption.
Promoter's Discretion (Goodwill): Notwithstanding the above, the Promoter, at its sole discretion, may choose to offer remedies as a gesture of goodwill, such as a credit note or voucher for a future event.
The event will proceed in the event of minor or general adverse weather (e.g., light rain, moderate wind). No refunds will be issued if the event proceeds, but a ticket holder chooses not to attend due to their personal assessment of the weather conditions.
